Non-Business Internet Information Service Fengling Registration Management Measures

Article 1 In order to standardize the filing and filing management of non-business Internet information services, promote the healthy development of the Internet information service industry, according to the “Internet Information Service Management Measures”, “Telecommunications Regulations of the People’s Republic of China” and other relevant laws, administrative regulations, this method is developed.

Article 2 Those who provide non-business Internet information services within the territory of the People’s Republic of China shall go through filing procedures, implement filing management, and apply this method.

Article 3 The Ministry of Information Industry of the People’s Republic of China (hereinafter referred to as the “Ministry of Information Industry”) supervises and guides the national non-business Internet information service Fengling management work, and the provincial, autonomous region, and municipality telecommunications administration bureaus (hereinafter referred to as the province) The Telecommunications Administration”) implements the Fengling management of non-business Internet information services.

Those who intend to engage in non-business Internet information services shall go through the filing procedures with the telecommunications administration bureau of their domicile.

Article 4 The provincial telecommunications administration bureau shall follow the principles of openness, fairness, and justice in the Fengling management, and provide convenient, high-quality, and efficient services.

Non-business Internet information service providers should adhere to national regulations when engaging in non-business Internet information services and accept supervision and management by relevant departments in accordance with the law.

Article 5 Those who provide non-business Internet information services within the territory of the People’s Republic of China shall go through the filing procedures in accordance with the law.

Without registration, it is not allowed to engage in non-business Internet information services within the territory of the People’s Republic of China.

The so-called provision of non-business Internet information services within the territory of the People’s Republic of China in this method refers to organizations or individuals within the territory of the People’s Republic of China using websites accessed through Internet domain names or websites that can only be accessed through Internet IP addresses to provide non-business How much Internet information service.

Article 6 The Provincial Telecommunications Administration Bureau uses the Ministry of Information Industry’s Fengling management system to use online Fengling methods for Fengling management.

Article 7 Those who intend to engage in non-business Internet information services should fill in the “Non-Business Internet Information Service Fengling Registration Form” (hereinafter referred to as the “Filing Registration Form”, the format is shown in the appendix of this method) through the Ministry of Information Industry Fengling management system Perform the record filing procedures.

The Ministry of Information Industry adjusts and announces the “Fengling Registration Form” according to the actual situation.

Article 8 Those who intend to engage in non-business Internet information services through the access to the business Internet can entrust Internet access service operators, Internet data center business operators, and telecommunications business operators who provide access services for their websites in other ways to perform the record, Fengling change, and Fengling cancellation. Procedures.

Article 9 Those who intend to engage in non-business Internet information services through the access to the China Education and Research Computer Network, China Science and Technology Network, China International Economic and Trade Network, and China Great Wall Internet and other public welfare networks can be provided by their websites to provide Internet access services. Public welfare network units perform the record filing procedures, Fengling changes, and Fengling cancellation procedures on their behalf.

Article 10 Internet access service business operators, Internet data center business operators, telecom business operators who provide access services for websites in other ways, and public welfare network units (hereinafter collectively referred to as “Internet access service providers”) cannot know or should It’s known that organizations or individuals who intend to provide non-business Internet information services do not provide true Fengling information, and they will provide Fengling, Fengling changes, and Fengling cancellation procedures on their behalf.

Article 11 Those who intend to engage in news, publishing, education, health care, drugs and medical devices, culture, radio and television programs, and other Internet information services, according to laws, administrative regulations and national regulations, should be approved by relevant competent authorities. , When performing the record filing procedures, the relevant competent department’s approval documents should also be submitted to the Telecommunications Administration of the domicile.

Those who intend to provide electronic bulletin services should also submit special filing materials for electronic bulletin services to the Telecommunications Administration of the domicile when performing the filing procedures.

Article 12 After the Provincial Telecommunications Administration Bureau receives the Fengling materials submitted by the Fengling person, if the materials are complete, they should be Fengling within 20 working days, issue Fengling electronic verification identification and Fengling number to them, and through the Ministry of Information Industry Fengling management system The public releases relevant Fengling information; if the materials are incomplete, the Fengling will not be allowed and the Fengling person will be notified of the reason within 20 working days.

Article 13 Non-business Internet information service providers should mark their Fengling number in the center of the bottom of the homepage when they open their websites, and link the website of the Ministry of Information Industry Fengling management system below the Fengling number for the public to inquire and check.

Non-business Internet information service providers should place the Fengling electronic verification mark in the specified directory of their website when they open their website in accordance with the requirements of the Ministry of Information Industry Fengling Management System.

Article 14 Non-business Internet information service providers need to change the information filled in the “Fengling Registration Form” during the Fengling validity period, they should log in to the Ministry of Information Industry Fengling system 30 days in advance to perform the Fengling change procedures with the original Fengling authority.

Article 15 Non-business Internet information service providers need to terminate the service during the Fengling validity period, and they should log in to the Ministry of Information Industry Fengling system on the day the service is terminated to perform the Fengling cancellation procedure with the original Fengling authority.

Article 16 Non-business Internet information service providers should ensure that the information content provided is legal.

The so-called information content provided by non-business Internet information service providers in this method refers to the information content included under the Internet domain name or IP address of the website of the Internet information service provider.

Article 17 The Provincial Telecommunications Administration Bureau should establish management mechanisms such as credit management, social supervision, and situation investigation to supervise and manage non-business Internet information service activities.

Article 18 Internet access service providers shall not provide Internet access services for organizations or individuals who engage in non-business Internet information services without registration.

For non-business Internet information service providers who have been punished by the Provincial Telecommunications Administration Bureau for temporarily closing the website or closing the website, or organizations or individuals who are illegally engaged in non-business Internet information services, Internet access service providers should immediately suspend or terminate the provision of Internet access services to them. service.

Article 19 Internet access service providers should record the Fengling information of non-business Internet information service providers they access.

Internet access service providers should properly manage user information dynamics, record retention, report harmful information, and other network information security management work in accordance with national regulations, and supervise the users they access according to the requirements of the Ministry of Information Industry and the Provincial Telecommunications Administration.

Article 20 The Provincial Telecommunications Administration Bureau conducts annual reviews on non-business Internet information service Fengling in accordance with the law.

The Provincial Telecommunications Administration Bureau carries out annual audits through the Ministry of Information Industry Fengling Management System, using online methods.

Article 21 Non-business Internet information service providers should log in to the Ministry of Information Industry Fengling Management System at the specified time each year to perform annual review procedures.

Article 22 Violation of the provisions of Article 5 of this method, providing non-business Internet information services without performing the record filing procedures, the Provincial Telecommunications Administration Bureau of the domicile shall order a correction within a time limit and impose a fine of 10,000 yuan; if they refuse to correct, close the website.

If the service is provided beyond the project of the filing, the Provincial Telecommunications Administration Bureau of the domicile shall order a correction within a time limit, and impose a fine ranging from 5,000 yuan to 10,000 yuan; if it refuses to correct, it shall close the website and cancel the filing.

Article 23 Violation of the provisions of the first paragraph of Article 7 of this method, and filing false filing information, the Provincial Telecommunications Administration Bureau of the domicile will close the website and cancel the filing.

Article 24 For violations of the provisions of Articles 10, 18, and 19 of this method, the Provincial Telecommunications Administration Bureau of the place where the illegal act occurred shall order correction and impose a fine of 10,000 yuan.

Article 25 Violation of the provisions of Article 13 of this method, without linking the website of the Ministry of Information Industry Fengling Management System below its Fengling number, or failing to place the Fengling electronic verification sign in the designated directory of its website, the Provincial Telecommunications Administration Bureau of the domicile shall Order a correction and impose a fine ranging from 5,000 yuan to 10,000 yuan.

Article 26 In violation of the provisions of Articles 14 and 15 of this method, failing to comply with the record change procedures within the prescribed time, or failing to cancel the record in accordance with the law, the Provincial Telecommunications Administration Bureau of the domicile shall order correction within a time limit and impose a fine of 10,000 yuan.

Article 27 Non-business information service providers violate national laws and regulations and should suspend or terminate services according to law. The Provincial Telecommunications Administration Bureau may, based on the written identification opinion of the same level authorized by law and administrative regulations, temporarily close the website or close the website and cancel the Fengling.

Article 28 During the annual review, non-business Internet information service providers have one of the following situations, the Provincial Telecommunications Administration Bureau of their domicile announces through the Ministry of Information Industry Fengling System and other media to order corrections within a time limit; if they refuse to correct, they close the website and cancel the Fengling:

(1) Those who fail to log in to the Fengling website to submit annual review information within the specified time;

(2) Departments such as news, education, public security, safety, culture, radio and film, publishing, confidentiality and other national departments put forward annual review veto opinions on the special content under their jurisdiction according to law.

Article 29 This method will be implemented from March 20, 2005.
